Terms of Use

Effective date: October 19, 2026 · Last updated: October 19, 2026

These Terms of Use (“Terms”) are a binding agreement between you and Appetite Pal (“we,” “us,” or “our”) governing your use of the Appetite Pal mobile application, our website at https://appetitepal.com, and related services (together, the “Service”). By creating an account, purchasing a subscription or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Please read section 16 carefully. It contains a binding arbitration agreement and class action waiver that affect how disputes are resolved, unless you opt out within 30 days as described there.

1. Not medical advice

The Service is for general informational and educational purposes only. It is not a medical device and does not provide medical, nutritional, dietetic or health-care advice, diagnosis or treatment.

You are solely responsible for your health decisions and for how you use any information provided by the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. You represent that you are not barred from using the Service under applicable law.

3. Your account

You need an account to use the Service. You agree to provide accurate information, keep your sign-in credentials secure, and notify us promptly of any unauthorized use. You are responsible for activity that occurs under your account. You may delete your account at any time in the app (Settings → Delete account).

4. Subscriptions and payment

5. Fair use

To keep the Service reliable and affordable, AI features are subject to reasonable daily usage limits, which we may adjust. We may suspend or limit features for usage that is automated, abusive or far in excess of normal personal use.

6. AI features

7. Your content

You retain ownership of the photos, descriptions and other content you submit (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit and display Your Content solely to provide and secure the Service for you, including sending it to our service providers as described in the Privacy Policy. This license ends when Your Content is deleted from our systems, except as needed to comply with law. You represent that you have all rights necessary to grant this license.

8. Acceptable use

You agree not to: (a) use the Service unlawfully or in violation of these Terms; (b) copy, modify, distribute, sell or lease any part of the Service; (c) reverse engineer, decompile or attempt to extract the source code, models or prompts of the Service, except as permitted by law; (d) interfere with, disrupt or bypass the security, usage limits or subscription checks of the Service; (e) access the Service with bots, scrapers or other automated means; (f) impersonate any person or misrepresent your affiliation; (g) upload malware or harmful code; or (h) use the Service to build a competing product.

9. Our intellectual property

The Service, including its software, design, text, graphics, logos and trademarks, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms and your active subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. All rights not expressly granted are reserved.

10. Feedback

If you send us ideas or suggestions, you agree we may use them without restriction or compensation to you.

11. Third-party services

The Service relies on third-party services such as Apple, Google (Firebase) and Anthropic. Your use of those services may be subject to their terms, and we are not responsible for third-party services, their availability or their content.

12. Changes to the Service and these Terms

We may modify, suspend or discontinue any part of the Service at any time. We may update these Terms from time to time; we will post the updated Terms here and change the “Last updated” date, and for material changes we will notify you in the app or by email. Changes take effect when posted unless we state otherwise. Continuing to use the Service after changes take effect means you accept them. Changes to section 16 will not apply to disputes that arose before the change.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or others. Sections that by their nature should survive termination (including sections 1, 7, 9, 14, 15, 16 and 17) will survive.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment. We do not warrant that the Service, its nutrition estimates, calculations or AI output will be accurate, complete, reliable, uninterrupted, secure or error-free, or that it will help you achieve any particular health, weight or fitness result. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, in no event will we or our affiliates, officers, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or health-related outcomes, arising out of or relating to the Service or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages. Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid for the Service in the 12 months before the event giving rise to the claim, or (b) US $50. These limitations apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of them may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence where that is prohibited.

Indemnification. To the extent permitted by law, you agree to indemnify and hold harmless us and our affiliates, officers, employees and agents from any claims, damages, losses and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, Your Content or your violation of these Terms or any law.

16. Dispute resolution, arbitration and class action waiver

Informal resolution. Before filing a claim, you and we agree to try to resolve the dispute informally by contacting the other party with a written description of the claim. For claims against us, email support@appetitepal.com. If the dispute is not resolved within 60 days, either party may proceed as described below.

Binding arbitration. If you are located in the United States, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. The arbitration will take place in the county where you live or by video conference. Payment of fees will be governed by the AAA rules.

Class action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate claims of more than one person.

Opt-out. You may opt out of this arbitration agreement by emailing support@appetitepal.com with the subject “Arbitration Opt-Out,” including your name and the email or phone number on your account, within 30 days after you first accept these Terms. Opting out will not affect any other part of these Terms.

Severability of this section. If the class action waiver is found unenforceable for a claim, that claim must be severed and heard in court, and the rest of this section will continue to apply. If you are located outside the United States, this section does not apply, and you may bring claims in the courts available to you under mandatory local law.

17. Governing law and venue

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to section 16, the state and federal courts located in California have exclusive jurisdiction, and you and we consent to their personal jurisdiction. If you are a consumer in the EEA, UK or another country with mandatory consumer protections, you keep the protection of the mandatory laws of the country where you live and may bring proceedings there.

18. Apple App Store terms

If you obtained the app from Apple’s App Store, the following also applies, and in case of conflict with the rest of these Terms, this section controls with respect to the app:

  1. Parties. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. License. Your license to use the app is limited to a non-transferable license to use it on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing where enabled.
  3. Maintenance and support. We are solely responsible for providing maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
  4. Warranty. We are solely responsible for any product warranties not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  6. Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Third-party terms. You must comply with applicable third-party terms (such as your wireless carrier’s) when using the app.
  9. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

19. General

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior agreements. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. There are no third-party beneficiaries except as stated in section 18. We are not liable for delays or failures caused by events beyond our reasonable control. Headings are for convenience only.
